January 2010 

C. Richard ("Rick") Langley was selected for inclusion in the 22010 Super Lawyer for the State of Georgia.  Super Lawyer is a listing of outstanding attorneys that have attained the highest degree of peer recognition and professional achievement.

Joseph P. Durham, Jr. and William W. Calhoun, attorneys, were successful in obtaining a substantial, confidential settlement on behalf of their client who was injured in a collision with a semi truck owned by a grocery store chain.   

Rick Langley and Lauren M. Brock obtained a confidential settlement on behalf of their client, a banking institution, related to a wrongful foreclosure.

Joseph P. Durham, Jr. obtained a $150,000.00 settlement on behalf of an individual injured in a motor vehicle collision.

Lauren Brock has been selected to participate in Leadership Albany 2009-2010.  Leadership Albany was established in 1984 for the purpose of identifying and developing leaders in the Albany area, exposing them to issues and problems confronting the community, informing them about institutions in the community and providing a forum for the participants to better know each other.

Fred Lee made a presentation to senior nursing students at Georgia Southwestern State University in Americus on the subject of medical/legal issues in nursing practice.  

MARCH 12, 2009

Fred Lee attended “Strategies for Strengthening Non-Profit Boards,” a program presented by Dr. Steve W. Batson of Cargill Associates, and sponsored by the Albany Area Chamber of Commerce.  Fred attended as a member of the Board of the Southwest Georgia Chapter of the American Red Cross.

JANUARY 1, 2009

Firm member, Joseph P. Durham, Jr. has been admitted to practice law in the United States Court of Appeals for the Federal Circuit.

 Firm member, Joseph P. Durham, Jr. and C. Richard Langley obtained a settlement of $250,000.00 for a minor child who was injured while in foster care.

 Firm member, Joseph P. Durham, Jr. obtained an award of Two Million Dollars ($2,000,000.00) for the wrongful death of a woman who was killed in a car accident.

 Joe Durham and Rick Langley obtained a significant victory for their clients, a hospital and a licensed physical therapist, in the Supreme Court of Georgia, which denied the Plaintiffs’ request for certiorari.  The case involved allegations that a hospital employed physical therapist negligently performed therapy on the Plaintiff which resulted in her needing additional shoulder surgery.  The trial court granted the Defendants’ Motion to Dismiss on the grounds that the Plaintiff had failed to satisfy the pleading requirements set forth in Official Code of Georgia Annotated, Sections 9-11-9.1 and 24-9-67.1.  This dismissal was affirmed by the Court of Appeals and is one of the first cases in which the Georgia Appellate Courts have addressed the interaction between Official Code of Georgia Annotated, Sections 9-11-9.1 and 24-9-67.1.

 July 7, 2008

 Joe Durham and Rick Langley obtained multiple victories for their clients, a regional newspaper and a reporter in the Supreme Court of Georgia.  Specifically, the Supreme Court of Georgia denied the Plaintiff’s request for certiorari. 

 The case involved allegations that a regional newspaper and a reporter printed false information about a former City Clerk, who was charged with theft from the City and eventually plead “nolo” to one of the charges.  At the trial court level, Messrs Durham and Langley filed a motion for summary judgment on the grounds that the Plaintiff was a limited purpose public figure and that there was no evidence of malice, as required by Georgia law.  In response to this motion, the trial court granted the motion in part and denied it in part, ruling that the Plaintiff was a limited purpose public figure but finding there was a jury question as to the presence of malice.  The Georgia Court of Appeals subsequently affirmed the trial court’s ruling that the former clerk was a limited purpose public figure and reversed the trial court’s ruling regarding presence of malice.  This reversal was a ground-breaking decision as the Court of Appeals held that although the newspaper left an incorrect version of the story on its internet site for several months, the same could not be considered in the analysis of whether malice existed because the website was controlled by the advertising department rather than the news department.

Joe Durham was recently selected as one of Southwest Georgia's Forty under Forty. The award is given to individuals under the age of forty who have demonstrated leadership and community involvement in Southwest Georgia.

Bert Gregory, representing a railroad client, established precedent in a FELA case testing the application of the Daubert standard for expert witnesses.  The trial court granted a motion for partial summary judgment and a motion in limine excluding the testimony of a treating physician on the issue of causation.  The Georgia Court of Appeals affirmed the trial court’s decision, and the Georgia Supreme Court has denied certiorari.

Joe Durham and Rick Langley obtained a victory for their clients, a hospital and a licensed physical therapist, in the Georgia Court of Appeals.  The allegations were that a hospital employed physical therapist negligently performed therapy on a patient which resulted in the patient requiring four additional shoulder surgeries.  The trial court dismissed the claim on the grounds that the plaintiffs failed to come forth with competent expert testimony in support of their claim. The Court of Appeals affirmed the dismissal.

January 19, 2008

Joe Durham and Rick Langley obtained summary judgment on behalf of their hospital client in a medical malpractice case pending in the Superior Court of Dougherty County.  The allegations were that a hospital employed nurse violated the requisite standard of care by administering an excessive dose of morphine.  The trial court found that there was no evidence that the nurse’s actions caused any harm or injury to the patient

Joe Durham has become a member of the firm.  Joe began practicing with Langley & Lee, LLC in August of 2003 and his practice is focused on civil litigation with an emphasis on medical malpractice, catastrophic injury, and wrongful death litigation.
