Commerce. Fred attended as a member of the

Joe Durham and Rick Langley
obtained a significant victory for their clients, a
hospital and a licensed physical therapist, in the
Supreme Court of Georgia, which denied the
Plaintiffs’ request for certiorari. The case
involved allegations that a hospital employed
physical therapist negligently performed therapy on
the Plaintiff which resulted in her needing
additional shoulder surgery. The trial court
granted the Defendants’ Motion to Dismiss on the
grounds that the Plaintiff had failed to satisfy the
pleading requirements set forth in Official Code
of Georgia Annotated, Sections 9-11-9.1 and
24-9-67.1. This dismissal was affirmed by the Court
of Appeals and is one of the first cases in which
the Georgia Appellate Courts have addressed the
interaction between Official Code of Georgia
Annotated, Sections 9-11-9.1 and 24-9-67.1.

Joe Durham and Rick Langley
obtained multiple victories for their clients, a
regional newspaper and a reporter in the Supreme
Court of Georgia. Specifically, the Supreme Court
of Georgia denied the Plaintiff’s request for
certiorari.
The case involved allegations
that a regional newspaper and a reporter printed
false information about a former City Clerk, who was
charged with theft from the City and eventually
plead “nolo” to one of the charges. At the trial
court level, Messrs Durham and Langley filed a
motion for summary judgment on the grounds that the
Plaintiff was a limited purpose public figure and
that there was no evidence of malice, as required by
Georgia law. In response to this motion, the trial
court granted the motion in part and denied it in
part, ruling that the Plaintiff was a limited
purpose public figure but finding there was a jury
question as to the presence of malice. The Georgia
Court of Appeals subsequently affirmed the trial
court’s ruling that the former clerk was a limited
purpose public figure and reversed the trial court’s
ruling regarding presence of malice. This reversal
was a ground-breaking decision as the Court of
Appeals held that although the newspaper left an
incorrect version of the story on its internet site
for several months, the same could not be considered
in the analysis of whether malice existed because
the website was controlled by the advertising
department rather than the news department.

Forty under Forty. The award is given to individuals
under the age of forty who have demonstrated
leadership and community involvement in Southwest
Georgia.

Bert Gregory,
representing a railroad client, established
precedent in a FELA case testing the application of
the Daubert
standard for expert witnesses. The trial
court granted a motion for partial summary judgment
and a motion in limine excluding the testimony of a
treating physician on the issue of causation. The
Georgia Court of Appeals affirmed the trial court’s
decision, and the Georgia Supreme Court has denied
certiorari.

obtained a victory for their clients, a hospital and
a licensed physical therapist, in the Georgia Court
of Appeals. The allegations were that a hospital
employed physical therapist negligently performed
therapy on a patient which resulted in the patient
requiring four additional shoulder surgeries. The
trial court dismissed the claim on the grounds that
the plaintiffs failed to come forth with competent
expert testimony in support of their claim. The
Court of Appeals affirmed the dismissal.

obtained summary judgment on behalf of their
hospital client in a medical malpractice case
pending in the Superior Court of Dougherty County.
The allegations were that a hospital employed nurse
violated the requisite standard of care by
administering an excessive dose of morphine. The
trial court found that there was no evidence that
the nurse’s actions caused any harm or injury to the
patient
